  1. All prices in the online store at www.kopczynskakardas.com are expressed in Polish zlotys (PLN) and are gross amounts.

Orders

  1. The online store www.kopczynskakardas.com allows customers to:

    1. placing orders (purchase offers) for goods available in the online store and concluding distance sales contracts.

    2. obtaining information about goods and services available in the online store.

  2. The online store accepts orders via the website www.kopczynskakardas.com Orders are processed in the order they are placed .

  3. Placing an order is not tantamount to its acceptance.

  4. The moment of accepting the order is considered to be providing the ordering party with information about granting the status "shipped", and if the payment option has been selected - bank transfer - prepayment or electronic payment. The moment of concluding the contract is the payment to the account indicated by the seller.

  5. Supply

  6. The goods ordered in the online store are delivered through one of the available carriers selected when submitting the purchase offer.

  7. The time of receipt of the parcel consists of:

    1. order fulfillment time (payment method, packing the package).

    2. delivery time, depending on the selected delivery method.

  8. Unless otherwise agreed, Agnieszka Kopczyńska Kardaś shall deliver the goods no later than thirty days from the date of acceptance of the offer.

  9. The VAT invoice is sent electronically within 14 days from the delivery of the goods to the e-mail address provided when placing the order. In the absence of a document, such an event should be reported in order to supplement the gaps.

  10. After receiving the package, the customer should carefully check the condition of the package and its contents. In the event of any loss or damage, the customer should take all steps necessary to determine the liability of the carrier. In the event of damage, it is recommended to draw up a damage report.

Payment methods

  1. Payment for the goods may be made by the customer:

    1. Before issuing the goods to the customer:

      • By bank transfer to a bank account.

      • Credit card.

    2. Upon receipt of the goods on site:

      • Cash or credit card.

  1. Agnieszka Kopczyńska Kardaś may agree other, specific terms and forms of payment with the client. In this case, the terms and forms of payment indicated in the order confirmed as accepted for execution and the fulfillment of any additional requirements related to the agreed terms or form of payment shall apply.

  2. If you choose the method of payment - by bank transfer or credit card, the customer should pay the price immediately, and in the case of cash on delivery - on delivery.

Return of goods by the consumer

  1. A consumer who has concluded a distance contract may, within 14 days, withdraw from it without giving a reason and without incurring costs, except for the costs specified in art. 33, art. 34 sec. 2 and art. 35 of the Act of May 30, 2014 on consumer rights (Journal of Laws 2014.827). The consumer may withdraw from the contract by submitting an appropriate statement in writing - a form, a model of which is attached as Annex 2 to the above-mentioned the law.

  2. To meet this deadline, it is enough to send a statement before its expiry.

  3. The period for withdrawal from the contract begins from the date of delivery of the goods to the Customer by the carrier or, in the case of personal collection, from the date of receipt of the goods from the premises of Agnieszka Kopczyńska Kardaś Gallery.

  4. The items should be returned to the seller immediately, but not later than within 14 days of the withdrawal from the contract.

  5. The cost of returning the items is borne by the consumer.

  6. If the consumer exercises the right to withdraw from the contract after submitting a request in accordance with art. 15 sec. 3 and art. 21 sec. 2 above the Act of May 30, 2014 on consumer rights (Journal of Laws 2014.827), is obliged to pay for the services provided until the withdrawal from the contract.

Guarantee of quality

  1. It is absolutely necessary to keep the proof of purchase of the product issued by the Seller and attach the indicated document in the event of a complaint about the goods based on the guarantee granted.

Agnieszka Kopczyńska Kardaś gives the Customer a guarantee of quality and originality for products made individually, adequately to the type of materials used and the technique of product execution.

  1. The Customer's rights under the Guarantee shall expire automatically: in the event of any changes, modifications, supplements or replacements of the goods or any of its parts by the Customer; in the case of using the goods in a manner inconsistent with its intended use and instructions.

  2. Notification of a defect in the goods by the Customer and initiation of the complaint procedure takes place upon receipt of the Customer's declaration of the defect in the goods and the defective goods. Agnieszka Kopczyńska Kardaś Gallery considers complaints within 14 working days of receipt at the latest. If it is necessary to send defective goods, the warranty claim processing period may be extended to 28 working days.

  3. Method of delivering the item for renovation: The customer is obliged to send the product / painting at the expense of Agnieszka Kopczyńska Kardaś Gallery via Poczta Polska, using the cheapest delivery option, to the previously indicated address.

  4. Defective goods should be delivered by the Customer in the original packaging in which the goods were collected by the Customer, together with all the elements delivered to the Customer. The defective goods may be delivered by the Customer in a replacement package, which will ensure an appropriate level of protection of the goods during transport.

Complaints procedure

  1. If the purchased goods contain defects, the costs of returning the shipment are covered by Agnieszka Kopczyńska Kardaś Gallery.

  2. The customer sends information about the delivery of the goods to the e-mail address a.kopczynskakardas@gmail.com . The customer will receive an e-mail with the address to which the goods should be sent.

  3. The goods should contain the original packaging enabling safe transport.

  4. It is permissible to use a substitute packaging, but it should provide adequate protection during transport.

  5. The advertised goods must be accompanied by proof of the contract (e.g. a photocopy of the sales document)

  6. The method of delivering the goods as part of the complaint:

The goods are delivered free of charge; the customer should send the painting at the expense of Agnieszka Kopczyńska Kardaś Gallery via Poczta Polska, using the cheapest delivery option, to the address indicated above.

Final Provisions

  1. Agnieszka Kopczyńska Kardaś Gallery is responsible for defects in things. The rules of liability are contained in the Civil Code.

  2. Agnieszka Kopczyńska Kardaś informs about the possibility of using out-of-court methods of dealing with complaints and redress. The rules of access to these procedures are regulated by separate regulations (e.g. the Act of December 15, 2000 on the Trade Inspection, Journal of Laws 2001.4.25 as amended).

  3. In relation to the sale of non-consumer goods, the seller excludes liability under the warranty.

The deadline to withdraw from the contract expires after 14 days from the date of delivery of the goods to the Customer by the carrier or, in the case of personal collection, from the date of receipt of the goods from the premises of Agnieszka Kopczyńska Kardaś Gallery.

To exercise the right to withdraw from the contract, you must inform Agnieszka Kopczyńska Kardaś Gallery about your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post, fax or e-mail).

You may use the attached model withdrawal form, but it is not obligatory.

To keep the deadline for withdrawing from the contract, it is sufficient for you to send information regarding the exercise of your right to withdraw from the contract before the deadline to withdraw from the contract.

Consequences of withdrawal from the contract

  • You have the right to object to the processing indicated in point 3.3 c) to the processing of personal data in order to perform the legitimate interests pursued by the Administrator, including profiling, but the right to object may not be exercised if there are valid legally justified grounds for processing of your interests, rights and freedoms, in particular establishing, investigating or defending claims.

  • In relation to you, actions may be taken consisting in automated decision making, including profiling to provide services under the concluded contract and for the purpose of conducting direct marketing by the Administrator.

  • Personal data is not transferred from third countries within the meaning of the provisions on the protection of personal data. This means that we do not send them outside the European Union.
